2. Scope and acceptance

These Terms and Conditions of Sale govern online sales made by SCEA CLOS REAL to consumers through closreal.fr. The customer can review them before placing an order and accepts them when confirming the order. The applicable version is the version presented on the order date.

3. Products and legal drinking age

The essential characteristics, available quantities and price of each wine are shown on its product page. Photographs are provided for information and do not replace the product description. Offers remain subject to available stock.

The sale of alcohol to anyone under 18 is prohibited. By ordering alcoholic products, the customer confirms that they are at least 18 years old. Proof of age may be requested and the order may be refused if majority cannot be established. The parcel is handed over on delivery against the signature of an adult.

4. Prices

Prices are shown in euros and include French VAT at the applicable rate. Delivery charges and any other charge are shown before the customer confirms the order. The amount payable is the total displayed at checkout. A price change does not affect an order already accepted by the seller.

5. Ordering process

The customer selects products, reviews the cart, provides delivery and contact details, reviews the total and these Terms, selects a payment method, and confirms the order. The customer must correct any error before confirmation.

Receipt of an order is acknowledged electronically. The sale is accepted when the seller confirms the order after payment confirmation and stock verification. The seller may refuse or cancel an order for a legitimate reason, including payment failure, unavailable stock, a manifest pricing error, suspected fraud, or an unresolved dispute relating to an earlier order. Any amount collected for a canceled order will be refunded.

6. Payment

The available payment methods are displayed at checkout. Card and wallet payments are processed securely by Square. SCEA CLOS REAL does not store full card details. The customer guarantees that they are authorized to use the selected payment method. An unknown or pending payment status must not be treated as confirmation of payment.

7. Delivery

Available destinations, delivery methods, charges and the estimated delivery date or period are shown at checkout before payment. The customer is responsible for providing a complete and accurate delivery address.

Orders are delivered in metropolitan France by UPS. Shipping is charged at a flat rate of 20 EUR per order, displayed before the order is confirmed. A tracking link is emailed when the order is dispatched. As the goods are alcoholic beverages, the parcel is handed over against the signature of an adult.

The seller delivers by the date or within the period announced at checkout. If no date or period is stated, delivery will take place without undue delay and no later than 30 days after the order is concluded, subject to the consumer's statutory remedies in the event of delay.

Risk of loss or damage passes to the consumer when the consumer, or a third party designated by them other than the carrier, takes physical possession of the goods. Visible transport damage should be reported promptly to the carrier and to SCEA CLOS REAL without limiting the consumer's legal rights.

8. Right of withdrawal

The consumer has 14 calendar days from the day they, or a designated third party other than the carrier, receives the goods to withdraw without giving a reason. The decision must be sent before the deadline by an unambiguous statement, including by email, post, or the online submission form below.

After giving notice, the consumer must return the goods to the seller's registered address without undue delay and no later than 14 days after communicating the decision. Direct return costs are borne by the consumer. The consumer is liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

The seller refunds all payments received, including the cost of the least expensive standard delivery offered, no later than 14 days after being informed of the withdrawal. The refund uses the original payment method and carries no fee. The seller may withhold it until the goods are recovered or the consumer supplies evidence of dispatch, whichever occurs first.

Complete and submit this form to send your unambiguous withdrawal statement to Clos Réal. An immediate acknowledgment containing a receipt reference will be sent to the email address of your authenticated account.

9. Statutory guarantees

To invoke a statutory guarantee, contact the seller at the email or postal address stated in section 1 and identify the order and the product concerned.

10. Complaints and consumer mediation

Complaints may be sent with the relevant order number and supporting information to contact@closreal.fr.

After a prior written complaint that remains unresolved, the consumer may use consumer mediation free of charge. The identity and contact details of Clos Réal's appointed mediator are awaiting verification and will be added here before this option is presented as a complete referral channel.

11. Personal data

Personal data used to process orders, delivery, payment, customer requests and legal obligations is handled as described in the Privacy Policy.

12. Liability and force majeure

Each party remains liable for its obligations under applicable law. The seller is not liable for a failure or delay caused by an event beyond its reasonable control that qualifies as force majeure under French law. Mandatory consumer rights remain unaffected.

13. Governing law and disputes

These Terms are governed by French law, without depriving a consumer resident in another country of mandatory protections applicable in that country. If an amicable solution or mediation is unsuccessful, either party may bring the dispute before a court having jurisdiction under the applicable consumer and civil procedure rules. No court is granted exclusive jurisdiction by these Terms.
